BY USING THIS SERVICE, YOU AGREE TO THESE TERMS IN THEIR ENTIRETY.

These Terms constitute a legally binding agreement. If you do not agree, you must immediately cease all use of our services.

YOU WAIVE ALL RIGHTS TO SUE OR RECOVER ANY DAMAGES.

1. ACCEPTANCE AND MODIFICATION

By accessing or using the PACKZ platform, services, website, or any associated products (collectively, the "Service"), you unconditionally accept and agree to be bound by these Terms of Service ("Terms").

We reserve the absolute right to modify, update, or replace these Terms at any time without notice. Your continued use constitutes acceptance of all changes.

It is your sole responsibility to review these Terms periodically. Ignorance of updates is not a defense.

2. COMPLETE DISCLAIMER OF LIABILITY

ZERO LIABILITY PROVISION

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • WE SHALL HAVE ABSOLUTELY NO LIABILITY FOR ANY DAMAGES OF ANY KIND
  • WE ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE
  • WE ARE NOT LIABLE FOR ANY BUSINESS INTERRUPTION OR LOSS OF BUSINESS OPPORTUNITY
  • OUR TOTAL LIABILITY SHALL BE ZERO DOLLARS ($0.00)
  • YOU WAIVE ALL RIGHTS TO ANY REMEDY, COMPENSATION, OR REIMBURSEMENT

This limitation applies regardless of the legal theory, whether in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages.

3. COMPLETE INDEMNIFICATION

You agree to defend, indemnify, and hold harmless PACKZ, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against ALL claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including attorney fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any law or rights of any third party
  • Any content you submit, post, or transmit through the Service
  • Your negligent or intentional misconduct
  • Any taxes, fees, or penalties incurred

This indemnification obligation survives termination of these Terms and your use of the Service.

4. DISCLAIMER OF ALL WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE"

We expressly disclaim ALL warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Title
  • Security
  • Accuracy
  • Reliability

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

5. COMPLETE ASSUMPTION OF ALL RISK

YOU ACKNOWLEDGE AND AGREE THAT:

  • You use the Service entirely at your own risk
  • You may lose your entire investment or assets
  • Cryptocurrency and digital assets are extremely volatile
  • Smart contracts may contain bugs or vulnerabilities
  • The Service may cease operations at any time
  • Regulatory actions may make the Service illegal
  • You are solely responsible for any losses
  • You have conducted your own research and due diligence

BY USING THIS SERVICE, YOU ACCEPT THE RISK OF TOTAL LOSS.

6. MANDATORY ARBITRATION & CLASS ACTION WAIVER

PLEASE READ THIS CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Binding Arbitration:

Any dispute arising from these Terms or your use of the Service shall be resolved through binding individual arbitration in accordance with the rules of the American Arbitration Association.

Class Action Waiver:

YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE ACTION. All disputes must be brought in your individual capacity.

Jurisdiction:

These Terms shall be governed by the laws of the Cayman Islands. Any disputes not subject to arbitration shall be brought exclusively in the courts of the Cayman Islands.

7. ELIGIBILITY AND GEOGRAPHIC RESTRICTIONS

Age Requirement:

You must be at least 18 years old (or 21 in certain jurisdictions) to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

Geographic Restrictions:

The Service is not available to residents or citizens of:

  • United States (in certain states as restricted)
  • Countries under OFAC sanctions
  • Any jurisdiction where the Service would be illegal

You are solely responsible for compliance with local laws.

8. INTELLECTUAL PROPERTY RIGHTS

All content, features, and functionality of the Service are owned by PACKZ and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal use only.

This license may be terminated at any time for any reason without notice.

9. TERMINATION

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation:

  • Breach of these Terms
  • At our sole discretion
  • Upon request by law enforcement
  • Extended periods of inactivity
  • Fraudulent or illegal activity

Upon termination, your right to use the Service will immediately cease.

10. SEVERABILITY AND SURVIVAL

Severability:

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

Survival:

All provisions which by their nature should survive termination shall survive, including but not limited to: disclaimers, indemnification, limitations of liability, and dispute resolution provisions.

11. FORCE MAJEURE

We shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, pandemic, governmental action, war, terrorism, or other unforeseeable cause that is beyond our reasonable control.

ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and PACKZ regarding the use of the Service, superseding any prior agreements.

By continuing to use the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.
